I Interpretation and Definition
1. No part of this document shall supersede any law or regulation of Canada.

2. For the purpose of this document, a “Professional Member” is an individual who has met the CTSPA prerequisites and professional standards for membership.

3. The Canadian Technical Security Professional Association (CTSPA) is the recognized industry Professional Association of Technical Security (TS) professionals in Canada.

 

II Aims, Goals, and Objectives of the Code of Ethics
1) The aims, goals, and objectives of the CTSPA Code of Ethics are:

a) To ensure that a high standard of Technical Security (TS) professional services are provided by Professional Members of the CTSPA.

b) To maintain professional conduct among Members of the CTSPA.

c) To foster, enhance and maintain the relationship of CTSPA Members with clients, regulatory organizations, government, and non-members.

d) To open the lines of communication between professional members, address administrative or technical issues faced by the industry or members, seek and provide advice, exchange information and educate.

 

III General Standards of Conduct
Reputation of the Profession

1. Members will regard themselves as part of an important and respectable profession.

2. Members will ensure that their individual reputation, the reputation of other CTSPA collogues; the CTSPA and the Technical Security (TS) industry as a whole are maintained at all times.

3. CTSPA Members shall not engage in any activity for which they are not competent and / or qualified.

4. CTSPA Members shall adhere at all times to the Professional Standards and Best Recommended Practices as published as separate documents by the CTSPA.

5. Members shall conduct themselves in such a manner that reflects the highest standards of professional integrity.

6. Members shall protect the rights granted to all Canadians and allow others the same voluntary rights that you claim for yourself.

 

IV Compliance with the Code of Ethics
Members shall at all times adhere to the Code of Ethics and the CTSPA Bylaws as published as a separate CTSPA document.

Integrity and Due Care

1. CTSPA Professional Members will conduct due diligence to ensure that the identity of the client is verified and that the client has a lawful purpose to retain and instruct.

2. CTSPA Members will ensure that all employees, sub-contractors and other persons that assist in providing professional services adhere to this Code of Ethics whether a CTSPA professional Member or Non-Member.

3. CTSPA Members shall report any actions or dealings by another member that is deemed contrary to the CTSPA Code of Ethics.

Confidentiality of Information

1. Every Member will respect the privacy of clients and their right to confidentiality and understand his / her responsibility of so called “Need to Know” information.

2. Every CTSPA Member will conduct professional services in manner consistent with the Best Recommended Practices published as a separate CTSPA document.

3. Every Member shall ensure adequate physical security for client information, professional reports, and all other information collected in the course of providing professional services and will take all reasonable steps to protect against inadvertent or negligent disclosure.

4. Information provided by the association including CTSPA online resources, or as a benefit of membership shall be treated as confidential.

CTSPA Membership Fees

1. Annual membership fees must be paid in full when due.

2. Failure to renew membership when due, may result in the suspension of membership or the removal of the member from the professional association.

Advertising

1. No Member will make false or misleading claims as to technical or academic professional qualifications.

2. No Member shall make exaggerated claims about the operational capabilities of the equipment resources utilized to conduct a technical inspection.

3. Members are encouraged to acknowledge and promote their professional affiliation and membership with the CTSPA to create awareness and help foster the credibility and respect of the membership and the association.

4. The official CTSPA logo and other approved trademarks remain the property of the CTSPA and may be utilized to identify and promote CTSPA affiliation by members in good standing.

 

V Relationship with CTSPA Members
Courtesy and Consideration

1. CTSPA Members will support and work towards the achievement of the aims, goals and objectives of the Canadian Technical Security Professional Association (CTSPA).

2. Members are encouraged to consult with and employ the services of other CTSPA members (professional collogues) when an assignment may require additional expertise beyond his or her administrative, technical, or equipment capabilities.

3. CTSPA Members shall not take advantage of referrals by fellow members in order to interfere with the business relationships of the referring party.

4. Members shall not make false or misleading statements about another CTSPA Member.

 

VI The Application of Best Practices
Disclosure of Conflict of Interest

1. Members shall, at the first opportunity, disclose to the client any influence, interest or relationship, pertaining to a professional engagement, which, in the judgment of a reasonable person, may impair or interfere with the Members’ professional judgment or objectivity in carrying out the engagement.

2. Members may request the opinion of the CTSPA Ethics Committee as to the appropriateness of any business or client relationship relating to a potential Conflict of Interest situation.

Terms of Engagement

1. Members shall ensure that, prior to accepting an engagement, the objectives of the client are fully understood, are legal and that the client has been informed of the anticipated cost and time factor required to complete the Scope of Work anticipated.

2. Members shall disclose clearly the capabilities and limitations of the equipment resources, methods and techniques; time constraints, or other limitations imposed at the direction of the client.

Unqualified Opinions

1. CTSPA Members shall not provide opinions for which they are not professionally qualified.

2. When an opinion is deeded appropriate and necessary, it shall be clearly identified and declared as opinion.

Operational Reports

1. Reports to clients shall be complete, accurate, objective and unbiased.

2. Reports should not provide opinions without a factual foundation, unless clearly identified and declared as opinion.

CTSPA Ethics Committee

1. Jurisdiction – The Ethics Committee may serve as a mediator in minor disputes between Professional Members providing that both members agree.

2. The Ethics Committee may review, provide resolution, and take disciplinary action relating to accusations and violations of the CTSPA Code of Ethics.

Composition of the Ethics Committee

1. The election or appointment of Members in Good Standing on the Ethics Committee will be established in accordance with the CTSPA Bylaws as published as separate documents by the CTSPA.

Disciplinary Procedure

1. The violation of the CTSPA Code of Ethics, Bylaws, Professional Standards and / or Best Recommended Practices may result in review and / or sanction by the Ethics Committee.

2. A matter reviewed by the Ethics Committee may result in a formal written notice of violation.

3. A matter reviewed by the CTSPA Ethics Committee may result in the suspension of Professional Membership, or Expulsion of Professional Membership in the CTSPA.

4. The Ethics Committee may, at its sole discretion, notify the appropriate authorities, or regulatory agency at the Municipal, Provincial or Federal level where the conduct of the member is considered detrimental to the public good.
